Navigating campus life means understanding the laws of the State of Missouri and the City of Warrensburg. Ignorance of the law is not a defense; being informed is your best protection.


⚖️ The Basics: Age and Consumption

  • Legal Age: The legal drinking age in Missouri is 21. It is illegal to consume, purchase, or possess alcohol if you are under this age.

  • Minor in Possession (MIP) by Consumption: You do not have to be holding a can or bottle to be charged. If a police officer has reason to suspect you have been drinking (through a breathalyzer or physical signs), you can be charged with an MIP under "consumption" laws.

  • Penalties: Illegal possession or distribution is a misdemeanor. Conviction can lead to:

    • Fines up to $1,000.

    • Up to one year in jail.

    • A permanent criminal record that must be disclosed on job and grad school applications.


🆘 Lifesaving Protections: Good Samaritan & Amnesty

Your safety and the safety of your friends come first. Both the State and the University provide protections to encourage you to call for help during medical emergencies.

Missouri's Good Samaritan Law (RSMO 195.205)

If you witness or experience an overdose or medical emergency, you are protected from arrest or prosecution for certain violations (MIP, possession of a controlled substance/paraphernalia, altered ID) if you actively seek medical assistance by calling 911.

UCM Emergency Amnesty Policy

The University provides similar protection against disciplinary action for students who seek immediate help.

Action Required: To receive amnesty, you must seek help immediately by calling 911, Public Safety (660-543-4123), or contacting a Community Advisor (CA).


🚗 Driving Under the Influence

Missouri enforcement is strict, especially for those under the legal drinking age.

Law   Limit (BAC)      Consequence
Zero Tolerance (Under 21)   .02% or greater      Immediate loss of driver's license.
DWI Standard (Any Age)   .08% or greater      License taken on the spot; high fines; potential jail time.

The Reality: A DWI conviction often costs thousands of dollars in attorney fees and insurance premiums, along with a criminal record.

  • Be Smart: Use a designated driver (someone who has had zero alcohol), a cab, or the Night Ryder bus.


🏠 Hosting & Off-Campus Parties

If you host a party, you are responsible for what happens on your property.

  • Social Host Liability: It is a misdemeanor to knowingly allow anyone under 21 to drink on your property or to fail to stop a minor from drinking.

  • Selling Alcohol: Charging admission ("cover charge") at a party where alcohol is served can be charged as selling alcohol without a license, punishable by up to two years in prison.

  • Keg Registration: All kegs are tracked. If a keg is confiscated at a party where minors are drinking, the person who purchased it can be identified and fined up to $1,000.


🚫 "Abuse and Lose" Laws

Your driving privileges are tied to your behavior, even if you aren't behind the wheel. Under Abuse and Lose, a person under 21 will have their license suspended or revoked for:

  1. Any alcohol-related traffic offense.

  2. Any possession or use of a controlled substance.

  3. The modification or misrepresentation of a driver's license (Fake ID).

Is a misdemeanor a "big deal"?

Yes. A misdemeanor can stay on your record for life. It can disqualify you from medical school, law school, and many corporate careers.

Do police check off-campus parties?

Yes. Police respond to noise and parking complaints. Undercover officers also routinely check private parties for compliance. If you are a minor drinking at a private party, you risk both your arrest and the host's arrest.
